Affordable Care Act (ACA) Requirements and Notifications
The Affordable Care Act requires that the Cal Poly Corporation provide insurance coverage to all full-time employees. Full-time employees for ACA purposes are defined as follows:
Full-time employees–A full-time employee is an employee hired through a formal recruitment who is anticipated to work on a regular basis 30 hours per week or more. These employees are eligible for health insurance coverage the first of the month following their date of hire.
Variable hour employees– A variable hour employee is hired on a part-time basis in which the employer cannot determine at the employee’s start date whether the employee is reasonably expected to be employed on average at least 30 hours of service per week during the initial measurement period because the employee’s hours are variable or uncertain. All Cal Poly Corporation Student Assistants, Intermittent and CSU employees employed through the Cal Poly Corporation on an Additional Compensation basis fall into this category of employees. These employees are not eligible for health insurance coverage from the Cal Poly Corporation unless they qualify based on hours worked using the safe harbor optional look back measurement period under either the standard or initial measurement period.
The Standard Measurement Period for current variable hour employees is our W2 52 week period. For January, 1, 2014 coverage, the Standard Measurement Period for current employees will be December 22, 2012-December 20, 2013.
Our Initial Measurement Period for new employees will be the 52 week period following the end of the pay period in which they were hired.
If variable hour employees have worked on average 30 hours per week or more over the standard or initial measurement period, they will become eligible for medical coverage for a 52 week period.
